Article 13 of the Swiss Federal Constitution guarantees secrecy of post and telecommunications. The Federal Act on the Surveillance of Postal and Telecommunications Traffic (BUPF) regulates lawful interception narrowly. Self-hosted PBXes operated for a single organisation are typically below the licensing threshold for BUPF surveillance obligations.
For data protection, the FADP (revised 2023) applies. Cross-border transfer to non-adequate countries needs SCC-equivalent contracts. EU/EEA is treated as adequate.
