The Digital Millennium Copyright Act is a United States law that requires hosting providers operating under US jurisdiction to remove content upon receiving a valid takedown notice. Hosting providers outside US jurisdiction are not legally bound by this law. Whether a provider acts on DMCA notices depends on their jurisdiction and internal policy - not on US law.
DMCA ignored hosting works by placing your server and data in a jurisdiction where the DMCA has no legal force. Providers operating under Romanian, Icelandic, Moldovan, or Malaysian law have no legal obligation to comply with US copyright takedown requests. They operate under local law, which may have very different and often higher standards for compelling content removal.
Frivolous and weaponized DMCA claims are a documented problem: competitors, trolls, and aggressive rights-holders routinely send notices against legitimate content. Offshore hosting in a non-US jurisdiction removes this vector. The content stays up while any legitimate dispute proceeds through proper legal channels in the host jurisdiction.
