DMCA-Ignored VPS Hosting in Romania

Most hosting providers receive a DMCA takedown email and suspend the content within 24 hours - either because they are legally obligated to (US-based hosts), or because they do it voluntarily to limit their own liability (many 'offshore' hosts in Netherlands, Germany, and even Iceland). We operate differently for three structural reasons:

• Romanian law does not incorporate DMCA: The DMCA is US law. It has no direct legal force in Romania. A takedown notice addressed to us from a US law firm is a piece of mail, not a binding legal instrument.
• EU law is narrower than you think: EU Article 17 (formerly Article 13) imposes upload-filter obligations on large platforms, not on hosting providers. As a hosting provider, our liability shield under EU law requires only that we act on court orders - not on unverified takedown letters.
• We do not auto-suspend on volume of complaints: Some 'offshore' hosts auto-suspend after N complaints to avoid being categorized as bad actors by upstream providers. We review each complaint manually and take action only when a Romanian court orders it, or when the content crosses universal red lines (CSAM, terrorism).

Practically, your content stays online regardless of how many DMCA letters a copyright holder files. The only path to a forced takedown is a Romanian court order - and that requires a real legal violation under Romanian law, not just a foreign copyright claim.

Romania doesn't honor extraterritorial DMCA requests. Takedowns require Romanian court orders following EU due process — not a one-line email from a copyright holder. This keeps content online unless there's actual legal cause.

Romania joined the EU in 2007, which means it operates under EU fundamental rights law including the right to data protection and privacy. But EU membership does not mean DMCA compliance - the EU has its own copyright framework (EUCD/DSM Directive) that is structurally different from the US DMCA in ways that matter for hosting:

• No safe harbor conditioned on takedown compliance: The EU hosting safe harbor (E-Commerce Directive Art. 14) does not require providers to process takedown notices - only to act on court orders or equivalent legal authority.
• No statutory damages for hosting providers: The DMCA's $150,000-per-work statutory damages threat that drives US providers to over-comply does not exist in Romanian law. There is no financial penalty for not acting on an unverified complaint.
• Local court process is slow and expensive: For a foreign rightsholder to force a takedown in Romania, they must file in Romanian court, in Romanian, via a Romanian attorney, under Romanian procedure. This is a real barrier, not a theoretical one.

The result: DMCA-ignored in Romania is not a marketing claim backed by nothing - it is the legally correct description of how content removal actually works here.

DMCA resistance is only half the equation. The other half is not leaving a paper trail that makes you identifiable to a litigating rightsholder before the server is even involved. Our signup flow is designed around that reality:

1. Create an account with any email. ProtonMail, Tutanota, SimpleLogin, or a one-time burner all work equally well. No phone number, no name, no address.
